The Patent Agents registered with the USPTO have the same knowledge and powers as Patent Attorneys to represent Clients before that agency, except that they cannot litigate or advise on infringement matters. That is why Patent Agents are an excellent option, usually much more economical than Attorneys, for everything related to the drafting and prosecution of patents before the USPTO.

The Patent Agent in a professional with a mainly technical background. To obtain this certification, one must first hold a degree in Engineering or Science, and then it is necessary to pass a demanding admission exam - the so-called "Patent Bar" - which requires demonstrating a thorough command of all the technical and legal aspects of patent prosecution before the USPTO.

Registration as a Patent Agent authorizes the Agent to prepare applications for their Clients, file them with the USPTO and carry out all the prosecution required before that public agency, in order to obtain the patent.  

​

Not being an Attorney, the Patent Agent is authorized to practice law only before the patent office, that is, the USPTO. The Patent Agent cannot give legal advice on licenses, contracts, or infringement of existing patents. 

​

Many Clients prefer to have a Patent Agent for the preparation and prosecution stage of your patents, because the Agent generally has deeper technical knowledge than the Attorney and in turn charges comparatively lower fees.

The Patent Attorney, in addition to having passed the Patent Bar, one must have graduated with a degree in Law in the U.S. and have passed the Bar exam of the State(s) in which they practice.

 

Like the Patent Agent, they are authorized to prepare applications for their Clients, file them with the USPTO and carry out all the prosecution operations required before that office to obtain the patent.

In addition to this, they can practice as counsel in Court, advise the Client and represent them in contracts, litigation and all kinds of activities typical of a legal professional.

​

Because we have broad legal competencies, in the United States attorneys usually charge high fees. Patent Attorneys in particular usually bill between $300 and $700 per hour (or even more, depending on the level of experience and the area). In many cases, it is essential to turn to them, especially if there is some situation of litigation, contracts or licenses involved. However, for everything that is prosecute the patent before the USPTO, the Patent Agent is fully qualified and, of course, legally authorized to carry out the entire procedure, generally at much more competitive costs.

As Patentes USA PLLC a solo practitioner firm, our low fixed cost structure allows us to minimize the negative impact of employee salaries, offices and other additional costs that large firms must incur, which is reflected in substantially lower fees for the Client.

 

The Team

Alan Stilman — Assistant and head of technical drawings and 3D models

 

Alan supports clients in the day-to-day of the process: he coordinates documentation, the follow-up of each case and communication with inventors. He also prepares the technical drawings for applications in accordance with the USPTO's formal requirements and develops 3D models of inventions from sketches, photos or CAD files.

Born in Buenos Aires, Argentina, a citizen of the Argentine Republic and the Italian Republic, Mariana graduated as an Industrial Engineer in 2000, at the Buenos Aires Regional School of the National Technological University. Shortly afterwards she settled with her family in the city of Punta del Este, Uruguay, where for ten years she successfully carried out activities as an entrepreneurial, mainly in the field of information technology.  

 

In 2012 she moved to the state of Florida, in the U.S., where she would complete a Master's in Business Administration (MBA) and later a Master's in Communication and Media, both at Lynn University in Boca Raton. With this wide range of knowledge and experience in various complementary disciplines, Mariana was an ideal candidate to sit for the Patent Bar and become Registered Patent Agent, which she achieved in July 2018.

 

From there, combining her experience as an entrepreneur with her Engineering background, her talent for languages and her new knowledge of U.S. Patent Law, Mariana founded Patentes USA PLLC to offer the public an excellent service as
Independent Patent Agent.

With decades of experience as an Engineer in the fields of communications, new technologies and information systems, both as an independent entrepreneur and as a consultant for third parties, Mariana has a solid background for carrying out patent procurement mechanical, electronic, chemical, process, design, as well as everything related to software/ e-commerce. In the field of informatics or computer science, Mariana masters everything related to graphic and industrial design, CMSs and creation of websites, manipulation of image, video and sound. She has basic knowledge of programming, databases and servers. Likewise, her background in Digital Media makes it easier for her to draft her own Patent Drawings.

Spanish (Native) - Perfect spoken and written command of her native language. 

English (Excellent) - Bilingual Level. Command of colloquial and technical English at a level that allows her to perfectly understand and handle, both orally and in writing, everything related to patents and their applications.

French (Advanced) - With more than 7 years of study and the DELF diploma from the Alliance Française, Mariana can understand complex texts in French, hold conversations and write informal communications in that language. 

Italian (Intermediate) - Thanks to her Italian roots, plus some travel and months of study, Mariana has a good level of comprehension of Italian, although she does not write or speak it properly. 

Japanese (Basic) - A few years of study. Elementary comprehension. Mariana reads and writes Hiragana, Katakana, and a few Kanji. Not enough to communicate in this language, but it can help.

Books, informative texts and academic articles 

An important part of being Patent Agent consists of being able to draft the technical specifications, the claimed features and the arguments in favor of granting the patent being applied for, accurately and persuasively. This is where  background as a writer is especially useful. Author of short stories, novels and academic articles in English and Spanish, she published her book “Planeta Lina” in 2010 (Trafford Publishing, ISBN: 9781426915482). She has also published articles on a wide variety of topics, in both Spanish and English, on Academic Background, Medium, and her personal website among others.
