RCE - Request for Continued Examination
An RCE (Request for Continued Examination) is a way to continue the prosecution of a plant or utility patent application after receiving a final rejection of one or more of its claims. It is also useful in cases where you wish to continue prosecution of the application after receiving a Notice of Allowance. An RCE may also be applicable when the application is in an appeal process before the PTAB or upon receiving an Ex Parte Quayle.
To continue prosecution through an RCE, some new argument or evidence, or some amendment to the original application, must be submitted.

For design patents, the RCE does not apply. In that case, consider filing a CPA. Contact us to discuss whether it is right for you.
